These terms and conditions apply to any purchases by you of goods or services from CRYSTAL JEFF PTY LTD ABN 86 675 095 548 (Ninja Crystal, we, us, our), including purchases made using the Ninja Crystal online store and purchases made at any physical Ninja Crystal store.

These terms and conditions apply to the exclusion of any terms on any order form or other document issued by you. We may update or amend these terms and conditions from time to time.

Liability
- Under the Australian Consumer Law and other statutes and regulations, there are some warranties and conditions that cannot be excluded, restricted or modified or can only be excluded, restricted or modified to a limited extent. The Promoter excludes (or limits) all guarantees, warranties, conditions or other terms and conditions to the extent allowable by these laws.
- The Promoter accepts no liability or responsibility of any kind for any defect with the Prize nor for any loss or damage whatsoever suffered (including indirect or consequential loss) which is suffered or sustained in connection with the Competition or a Prize in any way to the fullest extent allowable by law.
- All additional costs not expressly stated in these terms and conditions but incurred in acceptance and use of the Prize is the responsibility of the Winners and will NOT be the responsibility of the Promoter. The Winners will be responsible for paying for those costs not expressly set out in these terms and conditions and which may include additional taxes, postage or other ancillary costs which are the sole expense and responsibility of the Winners.
- If the Competition or Prize is not capable of running as planned due to any reason (including, but not limited to fraud, a state of emergency, natural disaster, war, technical failures, communicable disease (including Covid-19) or related government actions or restrictions, or any other causes), the Promoter reserves the right without liability to the entrants to cancel, modify, terminate or suspend the Competition, subject to applicable law.
- The Promoter is not responsible for any misdirected, late or incomprehensible entries in the Competition, or for any problems or technical malfunctions of any telephone network, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participation in or downloading or uploading any materials in this Competition.
Privacy
The Promotor may collect personal information about entrants in order to enable participation in this Competition, however no further use of this information will be made without the applicable entrant’s prior consent. The Promotor may be required to disclose personal information collected as part of this Competition to a relevant government authority or as otherwise required by law. General terms
- These terms and conditions shall be governed by the laws of Victoria, Australia.
Shipping & Delivery
Ninja Crystal provides shipping and delivery to all residential addresses in Australia. The following terms and conditions apply to shipping and delivery of Ninja Crystal products purchased through the online store. Title and Risk
As between you and Ninja Crystal, title and risk to any goods purchased by you from Ninja Crystal will remain with Ninja Crystal and will only pass to you on occurrence of both payment in full for those goods and successful delivery of those goods to the address nominated in your online order.
Placing Online Orders
Orders for goods and services are placed by you when you proceed through our online store, input your order details and payment information and confirm payment of the order. On successfully placing and making payment for an online order, we will send you an order confirmation to the email address you provided during the purchase process.
You are responsible for checking and confirming your order, including your order details, products, information and delivery address, are correct at the time of placing an online order. To the extent permitted by law, Ninja Crystal accepts no liability or responsibility for any incorrect orders or order details.
Once an online order is placed, Ninja Crystal is not generally able to make any amendments to product, customer, or delivery details. If the order has not been dispatched from our warehouse, we may be able to cancel the order and make changes to delivery information, however we cannot guarantee this.
Problems with Online Orders
Ninja Crystal reserves the right to cancel any order placed on the online store where there are errors, inaccuracies or out-of-date information regarding pricing, stock availability, product descriptions or other matters related to the online orders.
If your online order is cancelled for these reasons, we will contact you to make other arrangements (such as provision of substitute products). If you wish, you are entitled to a full and prompt refund for all amounts paid for any such cancelled online orders.
Ninja Crystal further reserves the right to cancel any online orders where Ninja Crystal reasonably believes or suspects that the order was placed fraudulently or maliciously.
Price
Prices for goods and services are as marked (both in-store and on the website), provided however that Ninja Crystal reserves the right to amend any prices at any time prior to purchase where Ninja Crystal believes there has been an error, mistake or the incorrect price was inadvertently given in relation to the good or service.
You are responsible for meeting all taxes, duties, charges and otherwise (including any customs and import taxes) associated with your purchase of goods and services from Ninja Crystal. If additional taxes or duties are payable on your purchase based on your region, these will be charged to you as part of the checkout process.
Unless otherwise stated in-store or on our online store, all prices are stated inclusive of GST and all other applicable taxes, and will be stated in Australian Dollars. Ninja Crystal is not responsible for any currency conversation rates charged as a result of you making your purchase with another currency.
Unauthorised purchases
Ninja Crystal makes the goods and services available for sale, both in-store and online, for personal use only and not for any wholesale purposes. You must not offer for resale any goods or services purchased from Ninja Crystal without Ninja Crystal’s express prior written consent.

Payment Options
We have set out the payment methods which we accept for payments in our stores and online. We may change these payment methods from time to time.
You are responsible for ensuring that you comply with the terms and conditions, including transaction limits or purchase requirements, and in particular in relation to any buy-now-pay-later service providers, for any payment method you utilise to make a purchase from Ninja Crystal.
Australian Consumer Law
Ninja Crystal’s goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
to cancel your service contract with us; and
to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
For any and all other claims against Ninja Crystal (whether for breach of contract, negligence or on any other basis):
Ninja Crystal’s total aggregate liability will be limited to the total amount actually paid by you for the goods or services that are the subject of the claims; and
Ninja Crystal will not be liable to you for any loss that does not arise naturally, that is, according to the usual course of things from the relevant breach, act or omission, even if such loss was known or ought reasonably to have been known to Ninja Crystal.
Apart from the guarantees provided under the Australian Consumer Law, the only conditions, guarantees and warranties which are binding on Ninja Crystal in respect of the state, quality or condition of the goods and the services are those imposed by statute which cannot be excluded.
